Rules of the In White store (“Regulations”)
Valid from June 1, 2022.
The rules of the In White store, which can be found at https://inwhite.store, determine the rules for placing orders and selling goods through the In White online store, as well as by phone and e-mail.
§ 1 Introductory provisions
1.1. Placing an order for goods by the Client through the online store https://inwhite.store (hereinafter - STORE) constitutes the Client's agreement with the provisions of this Regulation and the Client's obligation to comply with its rules. The client, who places an order for goods by phone or e-mail, receives information about the mandatory Rules before concluding the contract, and is also warned about the need to familiarize himself with its content and accept its rules.
1.2. Sales through the INTERNET STORE https://inwhite.store/, by phone or e-mail are carried out by the company In White, entered in the register of entrepreneurs of the National Court Register under the number KRS 0000960189, for which registered cases are kept in the District Court of Wrocław, IX Commercial Department of the National Court register, the store operates at the address: st. Waly Piastowskie 1/1508, 80-855, NIP: 5833446691.
1.3. The STORE operating at the address https://inwhite.store is used to make purchases of goods included in the In White offer, without the simultaneous physical presence of the parties, exclusively using one or more means of remote communication until the conclusion of the contract, inclusive.
1.4. Only persons with full legal capacity have the right to place orders and make purchases in the STORE.
1.5. The store's offer is valid on the territory of the Republic of Poland, as well as in other countries, except for Lithuania, where the exclusive representative of the In White brand is NIP 5833446691.
1.6. The main condition for the fulfillment of each order placed by the Client is the correct completion of the various stages of placing the order, such as: product selection, providing contact information, choosing a payment and delivery method, and confirming the order.
1.7. All prices are in PLN and include VAT. The price indicated for each product is mandatory at the time of ordering by the customer. The price of the product does not include the cost of delivery.
1.8. If the Consumer is obliged to pay more than the agreed price, which will include the elements specified in clause 1.7. above, In White will notify the Consumer of this fact. Additional costs are charged to the consumer only after receiving the express consent of the consumer.
1.9. All files, texts, photos or graphic elements on the website https://inwhite.store (hereinafter: “ Material ”) are protected by copyright and may not be used by the Client in any way and in any form without prior consent shop In particular, the customer does not have the right to:
- copying or duplicating the Material in any form or by any means,
- creation of derivative or similar works based on the Material,
- distribution and/or distribution of the Material,
- public presentation of the Material,
- use the Material in business activities, including for the provision of any services or for the purpose of delivering goods.
§ 2 Placing an order
2.1. Orders in the STORE can be placed through the STORE website (this form requires prior registration of the Buyer on the STORE website), by phone and e-mail. The client has the right to cancel registration in the STORE at any time.
2.2. After placing the order, In White will notify the client of its acceptance to the e-mail address specified by him, by phone or fax.
2.3. The contract between the Customer and In White is currently concluded:
- confirmation of the In White order - in the case of placing orders through the STORE website;
- The customer sends to the e-mail address of the STORE a statement of consent to conclude a contract in accordance with the order confirmed by In White in the case of placing orders by phone, e-mail or fax.
2.4. Orders can be placed 24 hours a day, all year round. Orders placed on weekdays after 3:00 p.m., on Saturdays, Sundays, and holidays are processed the next business day.
2.5. In White reserves the right that information on stock levels may differ from reality.

§ 3 Implementation of the contract
3.1. Orders are fulfilled by the In White Sales Office at Wały Piastowskie 1/1508, 80-855.
3.2. The customer of the In White online store receives information by e-mail after further changes to the status of the order. The following stages of the order:
- waiting for confirmation
- confirmed (sent to the warehouse to complete the order)
- completed (execution of trade document)
3.3. In White delivers the ordered product to the Customer via InPost courier or other transport companies according to the data contained in the confirmed order. The customer can also pick up his order at one of the stationary In White stores without incurring delivery costs.
3.4. If it is necessary to obtain additional information from In White in order to fulfill the order, In White reserves the right to contact the Customer by phone or e-mail at the number specified when placing the order. This number can also be used by the courier to contact the customer in case of difficulties with the delivery of the parcel with the goods.
3.5. In the absence of all the ordered goods, partial fulfillment of the order is possible at the request or with the consent of the customer. At the same time, the cost of delivery is calculated for each shipment in accordance with Clause 6 of these Regulations. In the event of such a situation, In White may contact the customer by phone or email to offer a replacement for the missing product.
3.6. In the case of non-compliance of the delivered goods with the completed order, the Buyer is obliged to immediately inform In White about this, that is, within 3 calendar days from the date of receipt of the shipment with the order.
3.7. The customer has the right to change the order until the product has been shipped In White. For this purpose, contact the In White sales office by phone or e-mail and provide the data to be changed. After their confirmation, the customer can change the order.
The customer cannot change the order accepted for execution according to the customer's specification or designed to meet his individual needs. The customer cannot cancel the order from the moment the In White product is shipped.
Non-standard goods or goods made according to the individual wishes of the customer, that is, with an embroidered logo or inscription, with changed sizes or other changes made by special order, as well as in a color that exceeds the standards of the catalog, are not subject to return or exchange.
§ 4 Order execution time
4.1. The Customer's order will be confirmed by In White immediately, but no later than within 7 days from the date of placing the order. In the case of impossibility of fulfilling the order, instead of confirmation, In White will inform the Customer about the impossibility of fulfilling the order no later than within 7 days from the date of placing the order.
4.2. The order fulfillment period, which is available in the online store, is 3 working days. The term of delivery of the ordered product depends on the chosen delivery method and is up to 5 days from the date of shipment of the In White product, unless the parties agree on another date.
Items covered by the order will be shipped In White within 4 weeks of the In White order confirmation date, unless the parties agree on a different date.
Order processing time for goods not available in the online store - that is, an order transferred to sewing after placing an order by the Customer - is up to 4 weeks from the date of confirmation of the order.
4.3. The order is sent after filling all the ordered goods.
4.4. The order can be implemented in parts only at the request of the customer.
4.5. In White reserves the right to refuse the execution of an order for reasons beyond its control, which it is obliged to immediately inform the customer about.
§ 5 Payment methods
5.1. In White accepts the following forms of payment for the ordered product:
- Use of payment systems: PayPal and PayU. After the payment is processed and the item is completed, the item is shipped by In White. The document confirming the sale is issued on the day of shipment of the goods and is attached to the shipment.
§ 6 Shipping costs
6.1. The cost of delivery depends on the chosen method of product delivery. The customer is informed about the delivery cost after adding the product to the cart. The cost of forwarding outside the territory of the Republic of Poland depends on the destination country, as well as on the size and weight of the shipment.
§ 7 Documents for sale
7.1. Each purchased product will be accompanied by a confirmation of purchase in accordance with the provisions of Polish law in the form of a cashier's check or a VAT invoice.
7.2. If the costs of delivery of goods are borne by the Buyer, the costs of delivery are specified in the goods document.
7.3. If the customer has made an advance payment, but the order has not yet been fulfilled, In White is obliged to issue an invoice confirming receipt of the advance payment within 7 days.
7.4. In White does not issue duplicate receipts.
7.5. Upon delivery of the goods to the buyer, he is obliged to check whether a check or invoice with VAT is attached to the goods. If a document confirming the purchase of the goods is not attached to the shipment, the Buyer must immediately contact the In White sales office.
7.6. To receive a VAT invoice, you must submit a request for it when filling out the contact form during the order process. Further invoicing is only possible until the order is shipped by In White. The customer must notify the In White sales office by telephone or e-mail immediately that they are ready to issue an invoice.
7.7. In case of return or replacement of the purchased goods, a correction to this document is written in the sales invoice.
§ 8 Warranty
8.1. In White provides a 365-day quality guarantee for the sold goods. The warranty period starts from the day of delivery of the goods to the buyer. After the expiration of the period specified in this section, the warranty rights become invalid.
8.2. In White, as a guarantor, is responsible for a physical defect in the product only if the defect causes the product to be unfit for ordinary, normal use and if the defect arose from a cause inherent in the product to the risk of accidental loss or damage to the product transferred to the customer.
8.3. If a defect is detected during the warranty period, which is notified to In White, In White undertakes to repair the damage by repairing the product under the warranty. After two unsuccessful repairs of the same product defect, the Buyer has the right to demand the replacement of the product with a defect-free product.
8.4. Legal regulation within the scope of the guarantee provided by In White is determined only by the provisions of clause 8 and clause 9 of these Rules.
8.5. In connection with the provision of a quality guarantee, In White excludes its responsibility under the guarantee for product defects. This does not apply to the sale of goods to the Consumer specified in clause 10.1. Position.
§ 9 Warranty claim procedure
9.1. The customer informs about the discovered defect of the goods in accordance with the procedure provided for in paragraph 2.6. of these Rules.
9.2. A complaint submitted by telephone is subject to written confirmation by the Customer.
9.3. The condition for consideration of a complaint is:
- submission by the Client of confirmation of the purchase of goods, and
- sending the purchased goods to In White, while the goods are sent at the expense of the client. Parcels sent to In White by cash on delivery are not accepted by In White.
9.4. In White considers claims immediately, but no later than 14 working days from the date of receipt of the advertised product together with proof of purchase. This term may be extended only for reasons beyond In White's control, of which In White will promptly notify the Customer.
9.5. When receiving a parcel with goods, the client is obliged to check its contents. The customer informs the person who delivers the goods (courier) of any visible damage to the goods (for example, the condition of the tapes, seals) and the protocol signed by the customer and the person who delivers the goods.
9.6. Mechanical damage to the cargo caused during transportation will be considered only on the basis of a written report of damage/non-conformities drawn up at the time of receiving the goods, in the presence of the courier and with his confirmation. In case of damage to the shipment, please refuse to accept it and draw up an appropriate certificate of damage. In accordance with the transport legislation, the recipient of the parcel, who noticed its damage after the departure of the courier, can report this by phone to the courier company.
9.7. The Client's failure to fulfill the obligations listed in clause 9 may be grounds for rejection of the Client's complaint or its negative consideration by In White.
9.7.1. If the complaint is accepted, In White will repair or replace the product or refund the cost of the product complained of, less any costs incurred by In White.
§ 10 Sale to the consumer
10.1. A consumer is a natural person who buys goods for purposes not directly related to professional or business activities.
10.2. To the Consumer, In White is responsible under the warranty for physical and legal defects of the product
10.3. The physical defect of the product consists in the non-compliance of the product sold with the contract, so if the product does not have the properties that it should have, resulting from the circumstances or purpose, it does not have the properties that In White provided to the Customer, are not suitable for the purposes for which the Consumer informed In White at the conclusion of the contract, and In White did not raise any objections to its intended use, the Product was delivered to the Consumer in an incomplete state.
10.4. A legal defect of the product occurs when the product is the property of a third party or encumbered by the right of a third party, when the limitation in use or regulation is the result of a decision or a decision of a competent authority.
10.5. In the case of the Consumer, the public assurances of the manufacturer or the entity that places the product on the market as part of its economic activity, or that represents itself as a manufacturer, are equated to In White assurances. However, In White is not liable if he or she did not know these assurances or could not have known them, or if these assurances could not have influenced the consumer's decision to enter into a sales contract, and if the content of these assurances was corrected prior to the conclusion of the purchase contract - sale.
10.6. In White is responsible under the warranty if a physical defect is discovered within two years from the date of delivery of the product to the Consumer. If a physical defect is discovered within one year from the date of handing over the goods, it is considered that the defect or its cause existed at the time of handing over the goods.
10.7. In White is responsible for the warranty for physical defects in the product that existed at the time when risk passed to the Consumer or arose due to a cause inherent in the product sold at the same time.
10.8. If the product is defective, the Consumer may submit a declaration of price reduction or withdrawal from the contract if In White does not immediately replace the defective product with a non-defective one or eliminate the defect. This limitation does not apply if the goods have already been replaced or repaired by In White or In White has not fulfilled its obligation to replace the goods with a defect-free one or to eliminate the defect.
10.9. If the product has a defect, the Consumer can also demand the replacement of the product with a defect-free one or the elimination of the defect.
10.10. The consumer can, instead of eliminating the defect offered by In White, demand the replacement of the product with a defect-free product or, instead of replacing the product, demand the elimination of the defect, if this is not possible. bring the goods into compliance with the contract in the manner chosen by the Consumer, or will require excessive costs in connection with the payment method proposed by In White.
10.11. The consumer cannot withdraw from the contract if the defect is insignificant.
10.12. In White recommends using good practices when using the offered products, including washing the garment according to the instructions on the labels, washing the product first (ie without attaching another garment), washing colored and white garments separately.
10.13. In White undertakes to provide an answer to the complaint within 14 days from the day of its receipt.
10.14. If the complaint is justified, In White undertakes to replace the defective product with a product without defects or to eliminate the defect within 14 days from the date of notification by the Consumer about the complaint.
10.15 In case of actual withdrawal from the contract, In White is obliged to return the payment within 14 days from the date of receipt of the refusal, provided that the payment will not be returned until the return of the goods or until the Consumer provides confirmation of their return.
10.16. The claim for the elimination of the defect or the replacement of the product with a product without defects expires one year after the date of discovery of the defect, but the statute of limitations cannot expire before the end of two years.
10.17. The consumer exercising warranty rights at the expense of In White will deliver the defective product to the Seller at the address specified in the clause. 2.6. Position.
§ 11 The consumer's right to withdraw from the contract
11.1. The consumer can withdraw from the contract of sale of the goods purchased in the STORE, without explaining the reasons, by submitting a corresponding application in writing within 14 days from the day of delivery of the goods (ie from the day of receipt of the goods by the consumer). ). To fulfill this deadline, it is enough to send an application before its end.
11.2. The right to withdraw from the concluded contract does not apply if the ordered product is manufactured according to the consumer's specifications or serves to satisfy his individual needs.
11.3. The consumer can withdraw from the contract by submitting an application for withdrawal from the contract In White. The statement template can be found at the address of the order placed on the website https://inwhite.store - a link with the address of the order is provided in the e-mail confirming the order sent to the address specified by the consumer.
11.4. The application for withdrawal from the contract should be sent to the address indicated in clause 2.6. Regulations with the note "Department of Exchanges and Complaints".
11.5. The consumer returns the product In White within 14 days from the date of withdrawal from the contract. To meet the deadline, it is enough to return the product before its expiration date.
11.6. The product is returned to the In White address specified in the clause. 2.6. Position.
11.7. Within 14 days from the date of receipt of the cancellation of the contract, In White will return all payments made to the Consumer, but the payment will not be reimbursed until the product is returned or the Consumer provides confirmation of its return.
11.8. In White will refund the payment using the same payment method used by the Consumer.
11.9. The consumer bears the costs of returning the goods to the seller. In the case of replacing the product with another, and the previous one corresponded to the order, the shipment is carried out at the expense of the client.
11.10. In order for an exchange or return to be accepted, the item must be intact; i.e. unworn, complete with tags, odorless.
11.11. There is no possibility of personal exchange/return in the salon.
11.12. In the event of an exchange, the shipping cost and/or price difference will be added as a delivery charge.
§ 12 Privacy Policy
The provisions of the privacy protection policy are specified in the document "Protection of personal data - privacy policy" located at the address Protection of personal data
§ 13 Final provisions
13.1. These Regulations shall enter into force from the date of their posting on the In White website, i.e. 06/01/2022.
13.2. Consolidation, protection and disclosure of the essential provisions of the concluded contract takes place by printing and handing it over to the Customer along with sending a document confirming the purchase of the goods and instructions on the possibility of withdrawing from the contract.
13.3. In White reserves the right to change the provisions of the Rules at any time. Any changes to the Regulations take effect from the moment they are announced on the In White website.
13.4. In matters not covered by the Regulation, provisions of Polish legislation shall apply.
13.5. Any disputes that may arise between the Client and In White will be resolved by a Polish court competent for In White. This does not apply to the sale of goods to the Consumer specified in clause 10.1. Position.
13.6. The Rules do not exclude or limit any rights of the Customer, who is a Consumer, to which he is entitled in accordance with the mandatory provisions of the law. In the event of a conflict between the provisions of the Regulation and the mandatory provisions of legislation granting rights to Consumers, these provisions shall prevail.
